Legal Notice of Annual School Budget Meeting, Budget Referendum & Election

NOTICE IS HEREBY GIVEN that the Annual School Budget Meeting (Public Hearing) for qualified district residents will be held remotely on Tuesday, June 2, 2020 at 7:00 p.m. Information regarding how the public may attend the hearing remotely will be provided on the District’s website.

 

FURTHER NOTICE IS HEREBY GIVEN that the Annual School Budget Referendum and Election for (1) approval of the Annual School District Budget for the 2020-21 School Year; and (2) voting on the purchase of replacement vehicles; and (3) the Election of two qualified district residents to the office of Member of the Board of Education – both for a three-year term to commence on July 1, 2020; and (4) for the transaction of such other business as is authorized by law, will be held on Tuesday, June 9, 2020. Pursuant to Executive Order 202.26, qualified voters shall only be permitted to vote via absentee ballot. Absentee ballots will be mailed to all known qualified voters with a postage paid return envelope. If you are a qualified voter and do not receive an absentee ballot, please contact the District Clerk Kristine DeMartino at (716) 926-2202 or by email at kristine.demartino@lscsd.org to request one. Completed absentee ballots must be received in the District Clerk’s Office by 5:00 p.m. on June 9, 2020.   

 

TAKE FURTHER NOTICE that a copy of the statement of the amount of money which will be required for the 2020-21 fiscal year for school purposes, exclusive of public monies, may be obtained by any District resident beginning May 26, 2020 through and including June 9, 2020, excluding weekends and holidays, at the District Office, 959 Beach Road, Angola, New York or in each school building between the hours of 8:00 a.m. and 4:00 p.m. As school buildings are not currently open to the general public, any individual desiring a copy of the proposed budget should contact the District Clerk Kristine DeMartino at (716) 926-2202 or by email at kristine.demartino@lscsd.org to make arrangements to obtain a copy.  

 

TAKE FURTHER NOTICE that any individual who desires to be placed on the ballot as a candidate for election to the Board of Education must complete a nominating petition to confirm that he or she meets all applicable eligibility requirements.  A nominating petition may be obtained on the District’s website or by contacting the District Clerk Kristine DeMartino at (716) 926-2202 or by email at kristine.demartino@lscsd.org. Completed nominating petitions must be received in the District Clerk’s Office by 5:00 p.m. on May 11, 2020. The two candidates who receive the highest number of votes at the Annual Meeting will fill the expired terms of the two incumbents and will serve on the Board of Education for three-year terms to commence on July 1, 2020 and expire June 30, 2023.   

 

TAKE FURTHER NOTICE that voting on the budget and other propositions will consist of voting on the following propositions, as well as other such matters as may be lawfully presented at the meeting:

 
PROPOSITION NO. 1

Shall the following resolution be adopted, to wit:

RESOLVED, that the budget for the Evans-Brant (Lake Shore) Central School District for the fiscal year commencing July 1, 2020, and ending June 30, 2021, as presented by the Board of Education in the amount of $60,057,225, is hereby approved and adopted and the required funds therefore are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law. Adoption of this budget requires a tax levy increase of 1.43% which does not exceed the statutory tax levy increase limit of 1.43%.

 
PROPOSITION NO. 2

Shall the following resolution be adopted, to wit:

RESOLVED, that the Board of Education of the Evans-Brant (Lake Shore) Central School District (the “District) is hereby authorized to purchase the following replacement vehicles for use by the District in the transportation of students and general use by the District:  three (3) full size diesel-powered 71-passenger school buses at an estimated maximum cost of $126,322.95 each; one (1) 30-passenger gasoline-powered school bus at an estimated cost of $66,484.49; and one (1) 24-passenger 5-wheel chair position gasoline-powered wheel chair school bus at an estimated cost of $74,986.13; for a total aggregate maximum cost of $520,439.47; with such aggregate cost to be raised by a tax upon the taxable property of the District to be levied and collected in annual installments as provided in Section 416 of the Education Law, with such tax to be partially offset by State aid available therefore, and, in anticipation of such tax, by the issuance of  debt obligations of the District as may be necessary, not to exceed such maximum aggregate cost. No tax levy increase is anticipated for Proposition No. 2.

 

TAKE FURTHER NOTICE that military voters who are qualified voters of the school district may apply for a military ballot. Applications for military ballots may be obtained from the District Clerk’s Office and the military voter may designate a preference to receive the application by mail, fax or email. Completed applications for military ballots must be received by the District Clerk or her designee by no later than 5:00 p.m. on May 14, 2020.

 

TAKE FURTHER NOTICE that a list of all persons to whom absentee voter ballots are issued will be available for public inspection between the hours of 8:00 a.m. and 4:00 p.m. in the office of the District Clerk on the five days prior to the annual meeting and election, except Sundays. As school buildings are not currently open to the general public, any individual desiring a copy of the list should contact the District Clerk Kristine DeMartino at (716) 926-2202 or by email at kristine.demartino@lscsd.org to make arrangements to inspect a copy. Any qualified voter may, upon examination of such list, file a written challenge of the qualifications as a voter of any person whose name appears on such list, stating the reasons for such challenge. Such written challenge shall be transmitted by the District Clerk to the Chief Election Inspector before the close of the polls.
